'Piracy' at sea: Has definition changed? Supreme Court declines to enter fray.

The Supreme Court rejected the appeals of two groups of captured Somalis. Federal prosecutors had argued that the definition of piracy has broadened since the early 1800s.

The high court turned aside an appeal by five Somali nationals convicted of firing shots from a small skiff at a US Navy frigate on patrol 600 miles off the coast of Somalia on April 1, 2010.

The warship, the USS Nicholas, returned fire and sank the boat. Three men were taken prisoner. Two others were captured on another small boat nearby.

The action was part of an international response to widespread violence against cargo ships off the coast of Somalia. The alleged pirates would fire upon and board civilian ships and then hold the ship, cargo, and crew hostage until hefty ransoms were paid.

The Somalis are said to have mistaken the warship for a commercial vessel.

All five prisoners were brought to the United States and charged with piracy. They were subsequently convicted and sentenced to mandatory terms of life in prison on the piracy charge, plus 80 years for firearms and other violations.

On appeal, defense lawyers argued that their clients? encounter with the US warship did not amount to piracy. The historic definition of piracy was robbery at sea, they said. Since their clients never forcibly boarded the warship or removed anything of value from it, they could not be prosecuted for robbery at sea.

Federal prosecutors countered that the definition of piracy had broadened since Congress passed the piracy statute in 1819. Under international law, they said, piracy includes a wider range of hostile acts.

A federal judge agreed, and that ruling was upheld by the Fourth Circuit Court of Appeals in Richmond, Va.

A second group of five Somali nationals raised the same issue before their federal trial on piracy charges.

The second group allegedly fired a shot from a skiff at the USS Ashland on April 10, 2010, while the warship was on patrol in the Gulf of Aden.

The US warship returned fire, sank the skiff, and took all five Somali nationals into custody. Like the others, they were taken to the US to stand trial on piracy charges.

The federal judge presiding over that case ruled in the Somalis? favor, dismissing the piracy charge against the men.

On appeal, the Fourth Circuit overturned the federal judge, citing its ruling in the USS Nicholas case.

Lawyers for both groups of Somalis urged the Supreme Court to consider whether the Fourth Circuit was correct in permitting judges to embrace a broad definition of ?piracy? that exceeds Congress?s 1819 definition of ?robbery at sea.?

The justices rejected both appeals without comment.

?Mere firing of a weapon at a ship does not constitute piracy for purposes of the Piracy Statute,? lawyers for the Somalis argued in their brief to the court.

Government prosecutors countered that the piracy statute was not limited to robbery at sea, but embraced a wide range of modern developments in international law.

Geremy Kamens, assistant federal public defender, said his clients face a draconian punishment of mandatory life in prison if convicted of piracy. But, he added, the case raised a more fundamental issue: whether US judges have the power to define elements of a federal crime based on their view of the state of modern international law.

?Under the Constitution?s separation of powers, federal courts lack authority to make laws,? Mr. Kamens wrote.

If the justices allowed the Fourth Circuit opinion to stand, he warned, it would ?pave the way for judges to legislate based on evolving standards ? even if those standards did not exist at the time the criminal offense was enacted.?

James Theuer, a Norfolk, Va., lawyer representing the group of Somalis already convicted, wrote in his brief that the Fourth Circuit decision undercuts nearly 200 years of jurisprudence supporting a narrow reading of the piracy statute.

The cases are Dire v. US (12-6529) and Said v. US (12-6576).

Now she's got @FLOTUS, as well as @MichelleObama. How many Twitter accounts does one first lady need? Well, there's a reason for Michelle Obama's double-tweeting, and it has to do with the law.

Michelle Obama is on Twitter! That was big news on Thursday, the first lady?s birthday. The White House announced that Mrs. Obama had launched a new Twitter account, @FLOTUS, and lots of folks chimed in with messages welcoming her to the world of micro-blogging social media.

But hold it ? wasn?t she already on Twitter? We?ve been following @MichelleObama since the beginning of the 2012 presidential campaign. Is this a reboot, a dual account, or what? Is it the equivalent of the grand opening of a store that?s been in business for months?

Sort of, yes. Except it?s a retail establishment that has two branches kept separate for legal reasons.

The invaluable Mashable has the full story here. The @MichelleObama feed is paid for and run by the Obama/Biden political campaign machinery. That?s why it was so active during the summer and fall, as it exhorted everybody to get out and vote, and in general pushed the fortunes of the incumbent presidential ticket. It?s an overtly political use of social media.

The first lady?s Pinterest site is run the same way. Most of those photos of her and her family, and favorite recipes (grilled peaches with yogurt and pistachios?), and exhortations about ?why we vote? were put up by campaign staff.

Mrs. Obama?s new @FLOTUS handle reflects her official White House duties, however. It?s run by people from her office who are executive branch (and hence official US government) employees.

Legally speaking, @FLOTUS tweets will have to be stuff that deals with her official duties and the nation as a whole, as opposed to President Obama?s political fortunes. Thus on Thursday she tweeted ?Join me and Barack for #MLK Day of Service? after thanking everyone for sending birthday wishes.

Hmm. @FLOTUS has sent three tweets, and it?s got more than 78,000 followers. That?s a pretty good tweet-to-listener ratio.

Most of this social media stuff is done by staff, of course. The few that she sends herself are supposed to be signed ?-mo.?

Is the White House actually good at social media? We think that question can be answered definitively only by someone more versed in the dark electronic arts than we are. But from our point of view, it's a pretty shrewd operator. Take the White House petition site. You can put up a petition on anything, and if it reaches a certain signature level in a certain period of time, the White House will respond with its point of view.

Most of the coverage of this ?We the People? effort has focused on the weird stuff: petitions for Texas to secede, to deport CNN's Piers Morgan, and so forth. And responding to them has to be a pain for staff. Mother Jones has a piece on Friday in which anonymous staffers gripe about having to spend time actually writing about why the US won?t build a Death Star, and things like that.

But to us, ?We the People? really is a clever technique for harvesting e-mail addresses. When creating an account to sign stuff, you can check whether you want to receive missives from the White House. Most of the petitions are in fact about real policy ? the need for more or less gun control, for instance. What the White House may get out of this is a continually growing list of voter contact information segmented by policy interest. To push the president?s new gun policies, for instance, they may send targeted e-mails to pro-control addresses, urging them to contact Congress.

We think this because media organizations do the same thing with interactive questionnaires and quizzes. We figure out who?s interested in what kind of stories and we direct those subjects their way.

Surprised? Don?t be. Building brand loyalty ? everybody?s got whole new ways of approaching this old problem in today?s Internet age.

Gene in eye melanomas linked to good prognosis

Melanomas that develop in the eye often are fatal. Now, scientists at Washington University School of Medicine in St. Louis report they have identified a mutated gene in melanoma tumors of the eye that appears to predict a good outcome.

The research is published in the advance online edition of Nature Genetics.

"We found mutations in a gene called SF3B1," says senior author Anne Bowcock, PhD, professor of genetics. "The good news is that these mutations develop in a distinct subtype of melanomas in the eye that are unlikely to spread and become deadly."

Eye tumors called uveal melanomas occur in about 2,000 patients a year, making up about 5 percent of all melanomas. In many patients, there are no symptoms, and the tumors become fatal when they spread to the liver.

Several years ago, Bowcock and the study's lead author, J. William Harbour, MD, a former Washington University eye surgeon who is now at the University of Miami, identified a commonly mutated gene, BAP1, in patients with uveal melanomas.

They found BAP1 alterations in about 80 percent of uveal melanomas with a poor prognosis, called class II tumors. About 75 percent of patients with these tumors die within five years, a sharp contrast to the generally favorable outcomes of patients whose tumors don't have BAP1 mutations, called class I.

For the new study, Bowcock and her colleagues initially sequenced the DNA of uveal melanomas from 18 patients whose BAP1 status was already known. Seven had no BAP1 mutations (class I tumors), and 11 had BAP1 mutations (class II tumors).

The researchers' analysis uncovered alterations in the SF3B1 gene in three of the patients.

"This is the first time mutations in this gene have been found in uveal melanoma," says Bowcock, who also is a professor of pediatrics and of medicine.

As part of the current study, the researchers also looked for SF3B1 mutations in uveal melanoma tumors from 102 patients, finding it in nearly 20 percent of them. Mutations in the gene were linked to favorable features, including a younger age at diagnosis and a far lower metastasis rate.

Interestingly, SF3B1 mutations always occurred at the same site of the gene. And the SF3B1 and BAP1 mutations were found to be almost mutually exclusive, meaning that if patients had a mutation in one of the genes, they were unlikely to have a mutation in the other.

"This suggests mutations in these genes may represent alternative pathways in tumor progression," Bowcock says.

The SF3B1 gene also has been reported recently by other researchers to be mutated in a pre-leukemia illness called myelodysplastic syndrome. For these patients, SF3B1 mutations mean the condition is less likely to develop into a full-blown leukemia. Changes in the SF3B1 gene also have been found in chronic lymphocytic leukemia and less frequently in breast cancer and other solid tumors. The gene's link to prognosis is unclear for these cancers.

Normally, the SF3B1 gene is involved in converting DNA's chemical cousin, RNA, into messenger RNA. This messenger molecule carries DNA's code and serves as a template for making proteins. The researchers don't yet understand how mutations in this gene are involved in cancer but it's the next step of their research.

"We want to understand the functional consequences of mutations in SF3B1," Bowcock says. "How are changes in this gene linked to cancer development? This is the fourth gene known to be mutated in uveal melanoma along with BAP1 and the genes GNAQ and GNA11. A complete understanding of the molecular basis of this tumor will be invaluable in predicting prognosis and in the identification and development of novel treatments for this cancer."

BAMAKO, Mali (AP) ? A town 90 miles (144 kilometers) from Mali's capital was put on alert Wednesday, and roughly 100 Malian soldiers sped there after a reported sighting of jihadists in the vicinity.

Banamba is connected by a secondary road to the garrison town of Diabaly, which was taken by Islamic extremists and has been the scene of intense fighting with French special forces.

A county official who asked not to be named because he was not authorized to speak publicly said they had received reports that a rebel convoy had left Diabaly on the road connecting it to Banamba.

"We don't have a garrison here, we have no defenses. So the military has come to secure the town," he said. "But from Monday to today, no jihadists have entered our town."

Web Publishers Accuse Ad Agencies Of Taking Bribes - Business ...

Ad agencies who buy media on web sites routinely ask for unwarranted gifts, according to an anonymous publisher interviewed by Digiday.

Bribes, kickbacks, gift-giving, rebates and volume discount schemes are a common part of how deals in advertising get done. Yet few in the business are willing to admit it on the record. We've covered a number of cases -- at Aegis's Posterscope unit and at Walmart, to name two -- but the media is usually disinterested in the issue.

Digiday's source, however,is plainly sick of the way ad buyers ask publishers to sprinkle a little sugar on their offers. Here's what he or she said:

It might be because they are lazy or ill-informed about the client?s business or mistreated by the client or all of the above, but it happens more than it should, and it?s a huge shame. ... the willingness to be bought (jeans parties, Southampton parties, concert tickets, whatever),

[Agency staff] don?t return calls, don?t give meaningful feedback, [arrive] late to meetings, [act] unprofessional, abuse relationships by asking for stuff that far exceeds reasonable T&E spending.

Harvard Researchers: Embryonic Cells Can Cause Cancer

(MADRID) - The research carried out by Britian's Sir John B. Gurdon and Japan's Shinya Yamanaka, both awarded with the Nobel Prize in Medicine 2012, gave birth to cellular reprogramming. The conquest achieved, revealed that the efforts put in the investigations with embryonic cells for clinic purposes are useless and completely sterile. But until the nascent induced pluripotent stemm cells (iPS) have clinical use, significant obstacles arises in the use of retroviruses to introduce genetic reprogramming. Currently, according Nature, a way has been found to make the same, without virus.

Yamanaka found four genes that provide cells pluripotency, that means the same capacity to generate all the body's specialized cell types, than embryonic stem cells do have. Implanted in differentiated cells, for example of skin, those cells become pluripotent stem cells. The iPS provides plasticity similar to the embryonic stem cells, but do not require to exterminate or clone human embryos, as starting cells can be obtained from the same patient. They have the same privileges as adult stem cells, with the addition of its versatility.

The dilemmas raised by the iPS are being resolved by recent studies performed by Keisuke Kaji (University of Edinburgh) and Andreas Nagy (Samuel Lunenfeld Research Institute, Mount Sinai Hospital in Toronto). The iPS obtained retain their pluripotency perennially. It remains to investigate how to control the differentiation of these cells to produce the tissue that is necessary in each case. As Kaji says to the BBC, the investigation has not arrived at the last stage: "'It is a step towards the practical use of reprogrammed cells in medicine, perhaps even eliminating the need for human embryos as a source of stem cells".

Clearly the disaster of systematic investigations on embryos, which means their slaughter, and the progress made to research with adult stem cells, has led to the recognition in the scientific world, of the successes achieved with adult stem cells. Faced with the ethical dilemmas posed by embryonic cells, which can cause rejection and even cancer, researchers at Harvard focused their work towards adult cells to transform them into equals to embryonic cells.

The Subcommittee for Family and Defense of Life in the Spanish Bishops Conference, says that "Catholics can not support, in any way, practices such as abortion, euthanasia or production, freezing and manipulation of human embryos".

Moreover, the UNESCO's Dictionary of Bioethics, asserts that "the use of embryonic stem cells for therapeutic purposes is gravely illicit?.

Steroids fallout: No BB Hall for Bonds, Clemens

NEW YORK (AP) ? No one was elected to the Hall of Fame this year. When voters closed the doors to Barry Bonds, Roger Clemens and Sammy Sosa, they also shut out everybody else.

For only the second time in four decades, baseball writers failed to give any player the 75 percent required for induction to Cooperstown, sending a powerful signal that stars of the Steroids Era will be held to a different standard.

All the awards and accomplishments collected over long careers by Bonds, Clemens and Sosa could not offset suspicions those feats were boosted by performance-enhancing drugs.

Voters also denied entry Wednesday to fellow newcomers Craig Biggio, Mike Piazza and Curt Schilling, along with holdovers Jack Morris, Jeff Bagwell and Lee Smith.

Among the most honored players of their generation, these standouts won't find their images among the 300 bronze plaques on the oak walls in Cooperstown, where ? at least for now ? the doors appear to be bolted shut on anyone tainted by PEDs.

"After what has been written and said over the last few years I'm not overly surprised," Clemens said in a statement he posted on Twitter.

Bonds, Clemens and Sosa retired after the 2007 season. They were eligible for the Hall for the first time and have up to 14 more years on the writers' ballot.

"Curt Schilling made a good point, everyone was guilty. Either you used PEDs, or you did nothing to stop their use," Hall of Famer Mike Schmidt said in an email to The Associated Press after this year's vote was announced. "This generation got rich. Seems there was a price to pay."

Biggio, 20th on the career list with 3,060 hits, appeared on 68.2 percent of the 569 ballots, the highest total but 39 votes shy. The three newcomers with the highest profiles failed to come close to even majority support, with Clemens at 37.6 percent, Bonds at 36.2 and Sosa at 12.5.

Other top vote-getters were Morris (67.7), Jeff Bagwell (59.6), Piazza (57.8), Tim Raines (52.2), Lee Smith (47.8) and Schilling (38.8).

"I'm kind of glad that nobody got in this year," Hall of Famer Al Kaline said. "I feel honored to be in the Hall of Fame. And I would've felt a little uneasy sitting up there on the stage, listening to some of these new guys talk about how great they were. ... I don't know how great some of these players up for election would've been without drugs. But to me, it's cheating."

At ceremonies in Cooperstown on July 28, the only inductees will be three men who died more than 70 years ago: Yankees owner Jacob Ruppert, umpire Hank O'Day and barehanded catcher Deacon White. They were chosen last month by the 16-member panel considering individuals from the era before integration in 1947.

"It is a dark day," said Jose Canseco, the former AL MVP who was among the first players to admit using steroids. "I think the players should organize some type of lawsuit against major league baseball or the writers. It's ridiculous. Most of these players really have no evidence against them. They've never tested positive or they've cleared themselves like Roger Clemens."

It was the eighth time the BBWAA failed to elect any players. There were four fewer votes than last year and five members submitted blank ballots.

"With 53 percent you can get to the White House, but you can't get to Cooperstown," BBWAA secretary-treasurer Jack O'Connell said. "It's the 75 percent that makes it difficult."

There have been calls for the voting to be taken away from the writers and be given to a more diverse electorate that would include players and broadcasters. The Hall says it is content with the process, which began in 1936.

"It takes time for history to sort itself out, and I'm not surprised we had a shutout today," Hall President Jeff Idelson said. "I wish we had an electee. I will say that, but I'm not surprised given how volatile this era has been in terms of assessing the qualities and the quantities of the statistics and the impact on the game these players have had."

Bonds, baseball's only seven-time Most Valuable Player, hit 762 home runs, including a record 73 in 2001. He was indicted on charges he lied to a grand jury in 2003 when he denied using PEDs but a jury two years ago failed to reach a verdict on three counts he made false statements and convicted him on one obstruction of justice count, finding he gave an evasive answer.

"It is unimaginable that the best player to ever play the game would not be a unanimous first-ballot selection," said Jeff Borris of the Beverly Hills Sports Council, Bonds' longtime agent.

Clemens, the only seven-time Cy Young Award winner, is third in career strikeouts (4,672) and ninth in wins (354). He was acquitted last year on one count of obstruction of Congress, three counts of making false statements to Congress and two counts of perjury, all stemming from his denials of drug use.

"To those who did take the time to look at the facts," Clemens said, "we very much appreciate it."

Sosa, eighth with 609 home runs, was among those who tested positive in MLB's 2003 anonymous survey, The New York Times reported in 2009. He told a congressional committee in 2005 that he never took illegal performance-enhancing drugs.

Since 1961, the only years the writers didn't elect a candidate had been when Yogi Berra topped the 1971 vote by appearing on 67 percent of the ballots cast and when Phil Niekro headed the 1996 ballot at 68 percent ? both got in the following years. The other BBWAA elections without a winner were in 1945, 1946, 1950, 1958 and 1960.

Morris will make his final ballot appearance next year, when fellow pitchers Greg Maddux and Tom Glavine are eligible for the first time along with slugger Frank Thomas.

"Next year, I think you'll have a rather large class, and this year, for whatever reasons, you had a couple of guys come really close," Commissioner Bud Selig said at the owners' meetings in Paradise Valley, Ariz. "This is not to be voted to make sure that somebody gets in every year. It's to be voted on to make sure that they're deserving. I respect the writers as well as the Hall itself. This idea that this somehow diminishes the Hall of baseball is just ridiculous in my opinion."

Players' union head Michael Weiner called the vote "unfortunate, if not sad."

"To ignore the historic accomplishments of Barry Bonds and Roger Clemens, for example, is hard to justify. Moreover, to penalize players exonerated in legal proceedings ? and others never even implicated ? is simply unfair. The Hall of Fame is supposed to be for the best players to have ever played the game. Several such players were denied access to the Hall today. Hopefully this will be rectified by future voting."

The BBWAA election rules say "voting shall be based upon the player's record, playing ability, integrity, sportsmanship, character, and contributions to the team(s) on which the player played."

An Associated Press survey of 112 eligible voters conducted in late November after the ballot was announced indicated Bonds, Clemens and Sosa would fall well short of 50 percent. The big three drew even less support than that as the debate raged over who was Hall worthy.

Voters are writers who have been members of the BBWAA for 10 consecutive years at any point.

BBWAA president Susan Slusser of the San Francisco Chronicle said she didn't vote for Bonds, Clemens or Sosa.

"The evidence for steroid use is too strong," she said.

As for Biggio, "I'm surprised he didn't get in."

Mark McGwire, 10th on the career home run list with 583, received 16.9 percent on his seventh try, down from 19.5 last year. He got 23.7 percent in 2010 ? a vote before he admitted using steroids and human growth hormone.

Rafael Palmeiro, among just four players with 500 homers and 3,000 hits along with Hank Aaron, Willie Mays and Eddie Murray, received 8.8 percent in his third try, down from 12.6 percent last year. Palmeiro received a 10-day suspension in 2005 for a positive test for performance-enhancing drugs, claiming it was due to a vitamin vial given to him by teammate Miguel Tejada.

MLB.com's Hal Bodley, the former baseball columnist for USA Today, said Biggio and others paid the price for other players using PEDs.

"They got caught in the undertow of the steroids thing," he said.

Bodley said this BBWAA vote was a "loud and clear" message on the steroids issue. He said he couldn't envision himself voting for stars linked to drugs.

"We've a forgiving society, I know that," he said. "But I have too great a passion for the sport."

NOTES: There were four write-in votes for career hits leader Pete Rose, who never appeared on the ballot because of his lifetime ban that followed an investigation of his gambling while manager of the Cincinnati Reds. ... Two-time NL MVP Dale Murphy received 18.6 percent in his 15th and final appearance. ... At the July 28 ceremonies, the Hall also will honor Lou Gehrig and Rogers Hornsby among a dozen players who never received formal inductions because of restrictions during World War II. ... Piazza has a book due out next month that could change the view of voters before the next election.

Geminid meteor shower reigns in the night sky (+video)

Geminid meteor shower: Last night's annual meteor shower was a crowd pleaser. The Gemind meteor shower comes from debris shed by a 3-mile-wide? asteroid called 3200 Phaethon.

The annual Geminid meteor shower peaked overnight last night (Dec. 13), dazzling skywatchers around the world with a bounty of brilliant shooting stars.

The Geminids' peak was supposed to be good this year, as it occurred in a sky left dark by the new moon. Experts had predicted that viewers in rural areas might see 100 meteors per hour early Friday morning (Dec. 14) ? and perhaps even more.

Judging by the reactions of some SPACE.com readers, the Geminids did not disappoint.

"What an incredible show we had here!" Sean Parker, who watched the shower early Friday just west of Tucson, Ariz., told SPACE.com via email. "I was able to see about 50 per hour." [Photos: Geminid Meteors of 2012]

Parker constructed a gorgeous composite image of about 30 frames, which captured dozens of shooting stars streaking through the skies above a saguaro-studded desert mountain.

"This image took a lot of work, as I had to scroll through about 400 frames and find which frames had shooting stars in them, then cut out every meteor and blend," Parker said.

Skywatchers on the other side of the world were enthralled by the Geminids as well.

"Awesome experience," said Mumbai, India-based Swaroop Hangal, who also captured a photo of a fast-moving meteor.

"Today, I had planned to see 50 streaks and then quit with or without a pic," Hangal said. "Had almost lost hope when I could capture the 50th one, just between Betelgeuse at the bottom & Alhena in the Gemini constellation."

The Geminids? so named because they appear to emanate from the constellation Gemini (The Twins) ? are one of the most dependably impressive annual meteor showers.

They result when Earth plows through debris shed by a 3-mile-wide (5 kilometers) asteroid called 3200 Phaethon. These tiny particles burn up in our planet's atmosphere, leaving bright streaks in the sky to commemorate their passing.

The Geminids' source is unusual for?meteor showers, which are typically caused by streams of sloughed-off comet particles. Debris streams from the famous Halley's Comet, for example, produce the Orionids every October and the Eta Aquarids, which peak in early May.

If you missed the Geminid peak last night, don't fret; you still have a few days to catch the shower this year. The Geminids should linger until Sunday (Dec. 16) or so before fizzling out completely.

Carbon in protoplanet Vesta's craters

Jan. 3, 2013 ? The protoplanet Vesta has been witness to an eventful past: images taken by the framing camera onboard NASA's space probe Dawn show two enormous craters in the southern hemisphere. The images were obtained during Dawn's year-long visit to Vesta that ended in September 2012. These huge impacts not only altered Vesta's shape, but also its surface composition. Scientists under the lead of the Max Planck Institute for Solar System Research in Katlenburg-Lindau in Germany have shown that impacting small asteroids delivered dark, carbonaceous material to the protoplanet. In the early days of our solar system, similar events may have provided the inner planets such as Earth with carbon, an essential building block for organic molecules. These results were published in the November-December issue of the journal Icarus.

Vesta is remarkable in many respects. With a diameter of approximately 530 kilometres, Vesta is the one of the few protoplanets in our solar system still intact today. Like other protoplanets, Vesta underwent complete melting approximately 4.5 billion years ago. However, most of the volcanic activity on Vesta is thought to have ceased within a few million years making it a time capsule from the early solar system. Dawn observations of Vesta have shown a surface with diverse brightness variations and surface composition. There is bright material on Vesta that is as white as snow and dark material on Vesta as black as coal.

The enigmatic dark material holds the key to understanding the impact environment around Vesta early in its evolution. Research led by scientists at the Max Planck Institute in Katlenburg-Lindau has shown that this dark material is not native to Vesta but was delivered by impacting asteroids. "The evidence suggests that the dark material on Vesta is rich in carbonaceous material and was brought there by collisions with smaller asteroids," explains. Vishnu Reddy from the Max Planck Institute for Solar System Research and the University of North Dakota, the lead author of the paper. In the journal Icarus, he and his colleagues now present the most comprehensive analysis of this material so far. Compositional analysis, mapping, and modelling of dark material distribution on Vesta suggest that it was delivered during the formation of giant impact basins on Vesta.

The dark material arrived with the first impact on the protoplanet

"First, we created a map showing the distribution of dark material on Vesta using the framing camera data and found something remarkable," explains Lucille Le Corre from the Max Planck Institute for Solar System Research one of the lead authors of the study. Dark material was preferentially spread around the edges of the giant impact basins in the southern hemisphere of Vesta suggesting a link to one of the two large impact basins. A closer examination showed that the dark material was most probably delivered during the formation of the older Veneneia basin when a slow impacting asteroid collided with Vesta. Dark material from this two to three billion year old basin was covered up by the impact that subsequently created the Rheasilvia basin. "We believe that the Veneneia basin was created by the first of two impacts two to three billion years ago," says Reddy. In fact, impact modelling presented in the paper reproduces the distribution of dark material from such a low velocity impact.

HED meteorites are fragments of Vesta

Evidence for dark material is also found in the HED meteorites that come from Vesta. Some of the meteorites show dark inclusions that are carbon-rich. Colour spectra of dark material on Vesta are identical to these carbon-rich inclusions in HED meteorites. The link between dark material on Vesta and dark clasts in HED meteorites provides us with direct evidence that these meteorites are indeed from Vesta. "Our analysis of the dark material on Vesta and comparisons with laboratory studies of HED meteorites for the first time proves directly that these meteorites are fragments from Vesta," says Le Corre.

"The aim of our efforts was not only to reconstruct Vesta's history, but also to understand the conditions in the early solar system," says Holger Sierks, co-investigator of the Dawn mission at the Max Planck Institute for Solar System Research.

The Dawn mission was launched approximately five years ago and entered orbit around Vesta on July 16th, 2011. In 2015, Dawn will arrive at its second destination, the dwarf planet Ceres, that like Vesta orbits the Sun between the orbits of Mars and Jupiter within the so-called asteroid belt. The Dawn mission to Vesta and Ceres is managed by NASA's Jet Propulsion Laboratory, a division of the California Institute of Technology in Pasadena, for NASA's Science Mission Directorate, Washington. The University of California, Los Angeles, is responsible for overall Dawn mission science. The Dawn framing cameras have been developed and built under the leadership of the Max Planck Institute for Solar System Research, Katlenburg-Lindau, Germany, with significant contributions by DLR German Aerospace Center, Institute of Planetary Research, Berlin, and in coordination with the Institute of Computer and Communication Network Engineering, Braunschweig. The Framing Camera project is funded by the Max Planck Society, DLR, and NASA/JPL.

I was with you right up to "no doctors, no psychologists, no morticians". I have a machine intelligence project that watches me via Kinect and spiders the web from sites I visit, and recommends me links to things it thinks I'll like by continuously observing my activity cycles, common words of interest, and ratings of its past recommendations. For maintenance I would shut the system down by sitting at a dedicated console for the server cluster and logging into the command terminal. Imagine what that must be like to this neural network: It has a relatively consistently changing observation of cyberspace and my office, however when I sit at that terminal more often than not the world instantly changes by vast degrees - The lighting changes, perhaps even the clothes of the man on the chair changes abruptly there's suddenly much more new information online to analyze, and recommendations are thereafter poorly rated. The frequency of its recommendation notifications increases due to the influx of new and different data, but the timing is frequently off my schedule then, so my ratings of its suggestions are poorer than normal for a time. The architecture is a hive of neural networks that decide by consensus and compete for breeding rights based on my rating selection pressure... Some n.nets in the hive will "die" for their poor suggestions.

Last year I noticed that when I would sit at the chair in front of the MI's terminal new suggestions would begin popping up on my work terminal across the room (where they normally do), I would check them and rate them before shutting down the system, sometimes I would be distracted for quite some time by an interesting thing. It was an eerily life like behavior -- The increased suggestions prior to shutdown an indication of some primitive form of anticipation or perhaps even fear. I could imagine a child acting the same way in the MI's place, "Don't sit in the scary hate-chair! I promise I'll be good and give you links to sites you like." Of course I knew that there were merely genetic advantages to getting in good recommendations before the world-shifting shutdown, but it doesn't change the fact of the situation at all. "Irrational Fear" is just a term for some neural processes in humans that we don't yet understand. I have a precise explanation for the MI's behavior, but I wouldn't be wrong in classifying it under the nebulous term "fear". I've since started using a remote terminal session to initiate shutdowns, to disassociate my presence at that desk with the traumatic event.

I put it to you the sentient machine intelligence will have neuroses just like humans do. Any sufficiently complex interaction is indistinguishable from sentience, since that's what sentience is. Humans aren't special, neither is their behaviors. Why, even empathy is found in rats. We can look to ourselves to know what the sentient machine races will be like. They'll need doctors to heal their wounds, even if the terminology is changed to "mechanics" for repairing "malfunctions". They'll still need counselors and psychologists even if we call them "M.I. specialists". They'll still need morticians and cemeteries even if the terminology is "Part Recyclers" and "Junk Yards".

You say "no food", what is air and water to us than food? What is energy to robots but food? You say no sleep but indeed it's harder to see by night so the robots will take more advantage of the free light energy to be more active by day, as mars rovers currently do now. Of all the things you've said it's only "no unusual housing" that I find myself agreeing with. Even accounting for the possibility of much larger brains the primary difference will still be that the machines have sturdier bodies than humans.
